Pool fencing

Fence Requirements:
Height: At least 1.2 metres high.
Impassable: No gaps, openings or climbing elements through which a small child could squeeze or climb over. Hedges and low walls are therefore excluded.
Solid materials: Wrought iron, metal or glass are acceptable materials.
Ball test: A ball 10 cm in diameter must not be able to pass through any part of the fence, including the space between the ground and the bottom of the fence.

Pools affected:
The regulations apply to all outdoor residential pools (inground, semi-inground, above-ground or removable) that can hold 60 cm of water or more.
Spas with a capacity of less than 2,000 litres, natural bodies of water and water gardens are not affected.
Mandatory fencing:
A fence of at least 1.2 m in height is mandatory for in-ground or above-ground pools that are more than 60 cm deep.
The fence must prevent direct access to the pool from the house and yard, and must not be easily climbable.
The openings (doors) must be equipped with a safety device that closes and locks automatically.
Access control:
Above-ground pools less than 1.2 m in height and removable pools less than 1.4 m must also be fenced.
If the above-ground or removable pool is higher, access must be secured by a removable ladder with a safety door, a platform with a fence or a terrace attached to the house and fenced.
The pool equipment (filter, etc.) must not be able to be used to climb the fence.
Building walls:
A building wall can be part of the enclosure, but it must not have a door opening directly onto the pool or windows less than 3 m from the ground (unless the opening is limited).
Pools with diving boards:
Pools with diving boards must comply with the BNQ 9461-100 standard.
Additional information:
Municipalities may have stricter rules. It is important to check with your municipality.
A municipal permit is required to build, install or replace a pool, install a diving board or build an enclosure.
